One of the most popular I-601 waivers of excludability sought for Thai fiances and wives is the removal of a statement of inadmissibility based on the presumption of the consular officer that the person engaged in the practice of prostitution (or directly benefited Fruit of prostitution) in the previous 10 years.

Many people become confused with the idea of an exemption because they believe that the waiver is an appeal. " Indeed, the waiver is not an appeal. Decisions U.S. consular officer is not likely call when they make a factual determinations. Therefore, if, in fact, a consular officer concludes that the beneficiary Thai seeking a U.S. visa has been engaged in the practice of prostitution within the past 10 years, this decision can be appealed.

An exception is often taken to be an appeal because the waiver request is submitted after consular officer rendered his decision. In the case of a waiver, the underlying question of a ground of inadmissibility (deemed engage in prostitution) is not contested. Instead, the person seeking a waiver is conceding the finding of inadmissibility and tending the inadmissibility waived because the refusal to grant the exemption would result in "extreme" coercion, for the petitioner citizen U.S..

Not all waivers of inadmissibility to a finding of extreme hardship. More specifically, and the waiver HIV is based on the finding that the visa applicant will have adequate private health care and coverage in the U.S., which will not come from government resources. Meanwhile, certain grounds for inadmissibility no waiver available. Two examples of grounds of inadmissibility, without exception is a finding that a visa applicant falsely claimed U.S. Citizenship obtain any type of benefits in the past and have also found that the beneficiary Visa has a criminal record involving drugs (under current law, there is an exemption if the drug conviction was less than a certain amount prescribed by law for marijuana).

To obtain the waiver of prostitution, it is advisable to hire a competent lawyer. The requirement for the waiver is that the citizens of the United States prove that if the exemption is denied, the citizen must uproot themselves and move to live with the recipient Thailand. It must be demonstrated that this situation would cause "difficulties" extreme for the American citizen. The difficulties must be beyond the daily challenges and rising to a level that would put the American citizen in a situation almost unbearable.
